Position Summary & Description

The Office of Human Resources at Indiana University of Pennsylvania (IUP) is seeking an Employee and Labor Relations Manager – MGR 180 to join our team. Human Resources and Employee & Labor Relations are key functions within our organization. The Employee and Labor Relations Manager will support daily interactions between employees and management within the University, adding value that reflects business objectives and organizational cultural initiatives. This position is responsible for administering multiple labor agreements, assisting supervisors and managers with matters related to employee performance and other employee relations issues, and participating in grievance investigations and responses. This position will be responsible for developing and maintaining productive business relationships with management and local union leadership, as well as supporting employee engagement across the University.

An essential responsibility of this position will be assisting supervisors and managers in understanding, interpreting, and applying the non-faculty collective bargaining agreements, Commonwealth Management Directives, University and State System of Higher Education policies, rules, guidelines, and federal and state laws governing the terms and conditions of employment within the University through the provision of professional advice, training, and guidance in areas of employment and labor relations for the University.

This position will also be responsible for conducting position classification reviews and preparing technical reports and recommendations for the Director of Human Resources, Assistant Director of Human Resources, and senior executives, including the President. This position will work closely with the Human Resources Director, Assistant Director of Human Resources, and all members of Human Resources to understand various HR functions and will be expected to provide assistance and support for other areas of the department.

Success in this role will require consistent performance in a fast-paced environment with shifting priorities, excellent interpersonal and communication skills, the ability to work both independently and collaboratively on projects, and the ability to work well under pressure while maintaining a high level of confidentiality in dealing with complex and sensitive situations.

Position Qualifications

Specific Responsibilities:

Labor Relations

Investigate non-faculty staff workplace misconduct incidents in accordance with policy and the appropriate CBA;
Manage and coordinate the appropriate collective bargaining unit grievance process, including but not limited to: ensuring the grievance file is made and the information is recorded in the grievance tracking log;
Reviewing, investigating, responding, and processing the grievance forms in accordance with the timelines required; collecting, preparing and disseminating all relevant grievance materials/data at AGP meetings, managing discussions with collective bargaining representatives in a professional and informal manner; and serving as a liaison with IUP managers and personnel as required, especially as it relates to understanding and interpreting the CBA and discipline processes in connection with the grievance process.
Liaise with PASSHE Labor Relations staff on specific cases and issues.
Prepare grievance cases for presentation, when required.
Serve as Strike Contingency Planning point of contact/SharePoint Administrator.
Monitor the university’s overtime equalization process.
Facilitate workshops and relevant trainings.
Responsible for working with PASSHE attorneys regarding preparation of arbitration cases.
Campus point person and liaison for new HR/LR software or website inactions, including training staff on software; facilitating training sessions.
Responsible for management of the AFSCME Article 43 contracting M&D process for all facilities contracts.
Discuss individual situations with managers when appropriate behavior or lack of performance occurs and devise a plan for resolving such issues, including but not limited to identifying contributors to the poor performance or inappropriate behavior; developing a strategy for neutralizing or removing these reasons.
Provide advice and guidance to the manager to assist in developing a strategy to correct the behavior/improve performance.
Directly oversee the work of Management Technician – Labor Relations to ensure that all tasks are successfully completed in a timely manner.
Create and present trainings and presentations to university staff on HR or related topics.
Consult with HRD and ADHR, as appropriate.
Advise on discipline process including preparation, investigation and collection of data, pre-disciplinary conferences and level of discipline to be issued.
Assist with the development and implementation of policies and procedures.
Present for the University at related meetings and hearings.
Advise managers on the interpretation and the implementation of articles in non-faculty CBA’s.
Discuss strategies with managers to implement basis provisions (i.e., Leave of Absence situations) and the common law of LR.
Implement and remain abreast of arbitration decisions and their relations to the CBA, if relevant.
Develop, recommend and implement best practices for all LR processes in consultation with the HRD and ADHR.
Prepares and generates reports through computer applications, tools and packages. Review data trends and implement workflow improvements. Specifically, seniority and compliment reports.
Ensures compliance with PASSHE requirements, definitions, and deadlines as well as maintain consistency of data provided within the University and outside agencies/organizations.
Utilizes audits, files and logs.
Coordinates personnel actions for terminations and suspensions.

Classification

Responsible for AFSCME and SCUPA Classification of positions including grievance review. All work must be developed with the approval of the HRD and/or the ADHR. Position does not have independent authority for classification review or determinations.
Performs classification job analyses and recommends classification actions for both existing and proposed clerical, technical and professional occupations within the University by management or employee-initiated requests, or by grievances.
Prepares technical evaluations with analyses and classification recommendations.
Develops and maintains current job descriptions for staff, administrators, managers and non-instructional faculty members. Ensures all position descriptions are appropriate for the classification.
Reviews and classifies positions prior to being posted; ensures new and vacant positions are reviewed in a timely manner. As request reviews working out of class requests to determine if appropriate.
Performs job classification analyses upon request from the department manager or employee.
When needed, represents the university at classification grievance hearings.
Assists in making recommendations to department heads on organizational changes/needs to meet budgetary concerns while accommodating the organizational needs of the unit.
Ensures compliance with university compensation programs per the appropriate CBA and PASSHE Non-represented Employee Performance and Reward Manual.

Other Assigned Duties
Provides support by performing a variety of human resources functions to support the Office of Human Resources and University programs and services as needed.
Refers decisions that fall outside of the scope of the position to the HRD and ADHR.
Consults with others regarding decisions that will require inter-departmental cooperation.
Other related duties as assigned.

Minimum Qualifications:
Bachelor’s Degree in related field or a bachelor’s degree with relevant working experience.
Two (2) years previous work experience with unions and union environments.
Demonstrated work experience that provides a foundation for successful completion of job functions; including attention to detail in report writing, ability to collaborate effectively with all levels across the University, ability to maintain professionalism, objectivity and confidentiality when working with and investigating sensitive cases.
Excellent oral, written and interpersonal, and communication skills.

Preferred Qualifications:

Previous related work experience in Labor Relations and classification, preferred.
3-5 years of experience working in Human Resources.
Previous management experience in higher education.
Experience with software packages such as Microsoft Office, Banner, Sharepoint, NEOED, and SAP.
Master’s degree in related field.
HR Certification (HRCI or SHRM).

Essential Functions
